1. Acceptance of Terms
By accessing or using Eternal Vault ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Service Description
Eternal Vault provides a blockchain-based digital estate planning platform that enables users to:
- Create and manage digital asset vaults
- Designate beneficiaries for asset distribution
- Set release conditions for asset transfer
- Monitor vault status and activity
- Access AI-powered estate planning assistance
The Service operates on a non-custodial basis, meaning we never have access to or control over your private keys, wallet credentials, or the assets in your vaults. You maintain full ownership and control of your digital assets at all times.
3. User Responsibilities
As a user of Eternal Vault, you agree to:
Account Security
• Maintain the confidentiality of your wallet credentials and private keys • Use strong, unique passwords and enable two-factor authentication • Immediately notify us of any unauthorized access to your account • Accept responsibility for all activities under your account
Accurate Information
• Provide accurate, current, and complete information • Update your information as necessary to maintain accuracy • Ensure beneficiary information is accurate and up-to-date
Lawful Use
• Use the Service only for lawful purposes • Not use the Service to launder money or finance illegal activities • Comply with all applicable laws and regulations • Not attempt to circumvent any security measures
4. Prohibited Activities
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers
- Transmit viruses, malware, or other malicious code
- Impersonate another person or entity
- Use the Service to store or transfer stolen assets
- Engage in any activity that could harm Eternal Vault or its users
- Reverse engineer or attempt to extract source code
- Use automated systems to access the Service without permission
- Sell, resell, or redistribute access to the Service
- Use the Service in any way that could damage our reputation
5. Smart Contracts & Blockchain
Immutability
Once deployed, smart contracts operate autonomously on the blockchain. Transactions executed by smart contracts are irreversible and cannot be undone by Eternal Vault or any third party.
Gas Fees
All blockchain transactions require gas fees, which are paid to network validators. These fees are separate from any Eternal Vault service fees and are non-refundable.
Network Risks
Blockchain networks may experience congestion, high fees, or temporary unavailability. We are not responsible for delays or failures caused by network conditions.
Smart Contract Risks
While our smart contracts are audited by reputable firms, no code is guaranteed to be free of bugs or vulnerabilities. You acknowledge these inherent risks when using the Service.
6. Fees & Payments
Service Fees
Eternal Vault charges fees for certain services, as described on our pricing page. Fees are subject to change with 30 days notice.
Payment Terms
• Subscription fees are billed in advance • All fees are non-refundable unless otherwise stated • Failed payments may result in service suspension • You are responsible for all applicable taxes
Free Tier
Our free tier includes limited features as described on our pricing page. We reserve the right to modify free tier offerings at any time.
7. Intellectual Property
Our Property
The Service, including its original content, features, and functionality, is owned by Eternal Vault and protected by international copyright, trademark, and other intellectual property laws.
Your Content
You retain ownership of any content you submit to the Service. By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Service.
Feedback
Any feedback, suggestions, or ideas you provide may be used by us without obligation to you.
Trademarks
"Eternal Vault," our logo, and other marks are trademarks of Eternal Vault. You may not use these marks without our written permission.

No Financial or Legal Advice
The Service does not provide financial, legal, or tax advice. Content and AI assistance are for informational purposes only. Consult qualified professionals for advice specific to your situation.
"As Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Guarantee
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We do not guarantee any specific results from using the Service.
Third-Party Services
The Service may integrate with third-party services. We are not responsible for the availability, accuracy, or content of these services.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETERNAL VAULT SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from unauthorized access to your account
- Damages resulting from blockchain network issues or smart contract behavior
- Damages exceeding the amount you paid to Eternal Vault in the 12 months prior to the claim
Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability shall be limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Eternal Vault and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to the Service
- Your violation of any applicable laws or regulations
11. Termination
By You
You may terminate your account at any time by contacting support or using the account deletion feature. Termination does not affect any smart contracts already deployed.
By Us
We may terminate or suspend your account immediately, without prior notice, for any reason, including but not limited to: • Violation of these Terms • Suspected fraudulent or illegal activity • Non-payment of fees • At our sole discretion
Effect of Termination
Upon termination: • Your right to use the Service ceases immediately • Any deployed smart contracts continue to operate independently • Certain provisions of these Terms survive termination
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.
Class Action Waiver
You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
Exception
Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement or other urgent matters.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending an email notification for significant changes
Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
